The importance of protecting religious freedom: a call for reflection on the reform of the Penal Code

The Christian denominations that are members of the Interfaith Dialogue Table of Spain, together with other signatory religious communities, wish to express their concern regarding the announcement on September 17, 2024 by the Minister of the Presidency, Justice and Relations with the Courts, Mr. Félix Bolaños García, on the comprehensive reform of the Penal Code. Among the proposed measures, the repeal of the crime against religious feelings is contemplated, specifically article 525 of the Penal Code, which addresses public ridicule.

While we understand and respect the right to freedom of expression as a fundamental right, recognized constitutionally, it is important to emphasize that this right should not prevail over other equally essential rights, such as religious freedom, freedom of conscience and the dignity of people. All of these rights are fundamental to the well-being of a democratic society and must be balanced appropriately. Religious freedom, being an essential part of human rights, guarantees respect and peaceful coexistence among citizens, and is the basis that allows the full exercise of freedom of expression.

Furthermore, the normalisation of insults, stereotypes and ridicule against religious beliefs can have serious consequences, such as encouraging violent and aggressive behaviour against believers and places of worship, something that has already been seen in various European countries. The repeal of Article 525 could therefore put these fundamental rights at risk and, consequently, harmony and respect in society.

As representatives of our religious communities, we call on the government and political parties to act with awareness and responsibility to ensure respect for universal human rights, including the right to religious freedom. This right must be protected in its entirety, regardless of ideological considerations, in order to contribute to the common good and to the construction of a more just and respectful society.

We trust that dialogue and mutual respect, through the Advisory Commission on Religious Freedom, will be the appropriate means to address this important issue and safeguard the fundamental rights of all citizens.
